All communication to you from http://www.daybros.co.uk will be addressed to your email address as supplied when you register. If you do not receive a confirmation email after registering or placing an order please contact us immediately. Day Brothers will not be responsible if you should fail to receive emails sent to the email address you provide when you register. We reserve the right to amend the Terms & Conditions at any time, so you should check this page regularly to take note of any changes. Prices shown include VAT and are in British Pounds Sterling (GBP)
2: YOUR USE OF THIS WEBSITE
Misuse of this Website is prohibited. You must not use the site for any purpose that could damage the name of Day Brothers or any goodwill attached to the same. You must not use the website for illegal, criminal or fraudulent activity (including breaches of copyright, trademarks, patents and/or privacy) or in any manner which would cause harm or distress to any third party. Breaching this provision would constitute a criminal offence and any such breach will be reported to the relevant law enforcement authorities. Fraudulent use of credit cards will also be reported to the relevant authorities. Permission is granted to electronically copy and print only those areas of the site so required in the process of using the site as a shopping resource. Day Brothers collects and uses your personal data because it is necessary for legitimate business reasons for the processing of the sale of goods to yourself. When placing an order either via the website or over the telephone we will require your name, address and contact details and this information will only be used for the purposes of processing your order and managing your account with us or to update your details through ‘my account page’. This information will be stored for as long as your account is active and for no longer than 10 years.

Day Brothers reserves the right to refuse service and/ or to terminate accounts if these Terms and Conditions are violated.
6: TERMS OF SALE
Once you have placed an order with us, you will receive an email confirming receipt of your order where we will ask you to verify that all details of the order are correct. You should notify us immediately of any amendments you wish to make. Once we have verified the price and availability of the goods, you will receive an email confirming acceptance of your order, and confirmation that a contract has been made between us.
Whilst all items are offered for sale in good faith, occasionally, for reasons beyond our control, we may not be able to fulfill your order. Therefore a sale agreement will only exist between yourself and http://www.daybros.co.uk when you receive an email confirming your order has been dispatched. If for any reason your item is unavailable, we will contact you to offer you a substitute, or refund your payment.
Delivery and dispatch times may vary from time to time depending on the availability of products, but we aim to dispatch goods within two working days of acceptance of your order.
We can accept no responsibility for delays in delivery caused by postal delays and major striking action by postal services.
7: REFUNDS & CANCELLATION (INCORRECT/ FAULTY/ DAMAGED ITEMS)
You may cancel your order anytime during the online ordering process before you have confirmed payment details. Once you have confirmed your order, you can then cancel your contract at any time up to 7 working days beginning the day after receipt of your goods. To do this, please contact us immediately in writing, either by email or post.
There is no obligation for you to give any reason for cancellation, however, we do always welcome constructive feedback, so a brief explanation will help us to improve the service we offer to you and other customers in the future.
If you have received the goods and then decide to cancel, the goods must be returned to us at your own expense. The goods must be packaged adequately to protect against damage and return in its original condition for a refund within fourteen (14) days from delivery. Please obtain a Proof of Postage in order to provide proof that you have returned the goods in the unlikely event that we do not receive the returned package.
If you require a refund we will refund the price paid for the goods including the standard delivery charge (if one was charged at checkout) within fourteen (14) days of receiving your returned goods, provided that the the goods arrive at our PO BOX address (see contact page) within 14 days of delivery to you or your notify us of cancellation.
Refunds will only be made against the original credit/ debit card used.
If you have requested an exchange or replacement with the Customer Services Team, this will be proceeded within seven (7) working days of receiving your returned goods and delivered by standard delivery.
We will be happy to exchange or offer a refund on any goods that are received as damaged or faulty in any way, or not what you ordered. Please notify Day Brothers immediately by calling the Customer Services Team on 01727 822710 (Monday – Friday 9am – 5pm, excluding Bank Holidays).
8: DISCLAIMER
Other than where stated to the contrary, all persons (including their names and images), third party trademarks and images of third party products, services and/or locations featured on this Website are in no way affiliated, associated or linked with Day Brothers. The respective trademark owners own any trademarks/names featured on this Website. The use of a trademark or brand name in this Website is purely to describe or identify products and services and is not an endorsement of the same by Day Brothers.
